In India there is no statutory regulation for managing and protecting the confidential information. Any link with an external organization will normally result in an exchange of information. It is essential that during such period, the confidentiality be maintained until such time as adequate agreement such as Confidentiality Agreement or Non-Disclosure Agreement is executed.

 

In the light of the above, it is recommended that the following guidelines be observed:

 

  • Be aware of the risk of “casual” visitors to laboratories or such premises.
  • Before discussing the work with visitors to the laboratory with third parties, have a confidentiality agreement signed.
  • Ascertain your obligations under any contracts entered into, such as publication restrictions.
  • Ensure that any confidentiality undertaking is mutual.
  • Establish a system to monitor results periodically in order to assess patentability etc.
